ASC has made targeted adjustments to its label and on-pack claims to align with the EU Empowering Consumers Directive (EmpCo) across all EU markets and in response to varying approaches to enforcement being taken as the 27 EU Member States begin transposing the Directive into national law. The Directive will be applied from 27 September 2026.

Following clarification published by the European Commission on 27 November 2025, ASC conducted a detailed legal and regulatory review, including engagement with national authorities across EU Member States about the transposition into national legislation and consultation with external legal experts. ASC is taking a deliberately cautious and forward-looking approach to align with the new legal framework ahead of full application and to minimise regulatory risk for partners – thus we decided that an update to our claims and label was needed.

ASC has been working for some time on the development of a new label, including trademarking and comprehensive consumer testing to strengthen clarity and recognition. In light of the regulatory developments, we have decided to advance the timing of the new label’s launch to align it with the adjustments to our on-pack claims. This approach helps avoid multiple transitions within a short timeframe.

ASC has been monitoring the development of the Empowering Consumers Directive since its adoption. Throughout 2025, consultations with the European Commission and the Commission’s published FAQ guidance indicated that ASC’s label and claims were considered compliant with EmpCo.

In early 2026, as Member States began transposing the Directive into national law and clarifying enforcement approaches, the picture evolved. External legal advice indicated that some jurisdictions may apply stricter interpretations.

Once this potential enforcement risk became clear, ASC acted immediately and adopted a cautious and forward-looking approach and decided that an update to our label and claims was needed to minimise regulatory risk for partners.

No. ASC’s old label and claims were developed in accordance with the legislation in force at the time.

The EmpCo Directive introduces new rules and clarifications regarding environmental and sustainability-related claims, and strict rules on sustainability labels. ASC is well-aligned and compatible with the EmpCo requirements, although final compliance will ultimately depend on how Member States enforce the rules. Our adjustments reflect the evolving regulatory framework and a cautious approach to maintaining compliance once the new rules apply across EU markets. The updates reflect legal developments under the Directive, not concerns about the credibility or integrity of the ASC certification programme.

EEA countries (EU, Iceland, Norway and Liechtenstein) will implement EmpCo as it falls under the scope of the EEA Agreement.

The EU is the biggest trading partner of both the UK and Switzerland, so it is likely that both will align themselves with EU regulatory requirements, albeit at varying levels depending on their respective legislation and according to their own timelines.

Companies remain responsible for ensuring compliance with applicable laws in the markets where their products are placed on the market.

The ASC certification programme is unchanged, including its standards, audit model and assurance processes.

The updates relate to specific on-pack claim wording and presentation elements, the label, to ensure alignment with the Directive’s implementation in the various EU Member States. This will extend to marketing materials and a global roll out in due course.

No. The environmental and social requirements under ASC standards remain unchanged.

The update concerns how certain claims are presented on pack in the EU market. The underlying certification system and third-party verification model remain fully in place.

Partners may begin using the new label and updated on-pack claims once they receive the official label image files, revised claims wording and the updated Label User Guide from ASC.

For products placed on the EU market:

• From 16 March 2026: MSCI will accept ASC artwork submissions using the new ASC label and updated claims.
• From 1 July 2026: MSCI will only accept artwork with the new ASC label and updated claims.
• By 27 September 2026: Partners placing products on the EU market are advised to ensure that their packaging uses the new ASC label and updated claims to comply with the Empowering Consumers Directive.

For partners not placing products on the EU market:

• From 1 October 2026: Artwork using the new ASC label and updated claims may be submitted to MSCI for approval.
• From 1 April 2027: MSCI will no longer review artwork submissions using the old ASC label and claims.

Partners not placing products on the EU market are advised to transition to the new ASC label and updated claims across packaging, as well as off-pack marketing and communications, by 31 December 2027. Long shelf-life products with the old label may continue to be sold beyond until stock is exhausted, provided they were placed on the market before that date.

Companies remain responsible for ensuring compliance with applicable laws in the markets where their products are placed on the market.

MSCI will accept and review artwork submissions for new products using the new ASC label and updated claims from 16 March 2026.

Yes. The new label and updated claims will apply globally, and all ASC partners will transition to the new label.

For partners not placing products on the EU market, there is less immediate regulatory pressure, and transition may take place on a longer timeline.

The old label will be fully phased out globally by 31 December 2027.

The Directive does not currently provide for a formal grace period at EU level after 27 September 2026. However, enforcement lies with national competent authorities and implementation approaches may vary between Member States. We are aware that there are increasing calls at national level, aimed at the EU Commission, for a grace period for those products labelled before September 2026, or for guidance that could provide greater practical flexibility.

Authorities typically prioritise enforcement according to the gravity of any infringement and the specific circumstances of each case, which may include consideration of whether companies have made reasonable and proportionate efforts for and towards compliance.

Decisions on whether to continue using existing packaging or withdraw it may depend on the individual trader’s risk policy, taking into account factors such as their possibility to demonstrate intention to change, the markets in which products are sold and their own interpretation of enforcement risk at national level, and based on all information provided on the packaging including the ASC label and claims.

Where unsure, independent legal advice may help inform commercial decisions, given it is the responsibility of the trader to ensure compliance with the applicable law of all packaging brought to market.

Redesigns for previously approved products do not need to be sent to MSCI for approval when the old label and claims are changed to the new label and updated claims. Partners can make these changes but do not need to send the updated artwork to MSCI for approval. This applies only to changes to the new label and updated claims.

New products with the new label and updated claims need to be approved. The normal artwork approval process through MSCI applies.

Partners should review their packaging schedules and transition to the new label and updated claims as part of their next print runs, taking into account the regulatory timelines in the markets where their products are placed on the market.

Yes. All consumer-facing products, including own-brand products carrying the ASC label will need to adopt the new label and updated claims within the communicated transition timeline.

EmpCo requirements apply from 27 September 2026. ASC is prioritising guidance on packaging updates due to the longer production lead times typically involved.

For any off packaging printed materials that feature the ASC label, partners should review their schedules and transition to the new label, and updated claims if relevant, as part of their next print run, taking into account the regulatory timelines in the markets where their products are placed on the market.

The same applies for use of the ASC label and claims digitally. The normal approval process through MSCI applies to any redesigned printed and digital materials with the new label and updated claims.

Additional guidance and supporting materials for marketing and communications will be shared with partners in the coming weeks, including resources designed to support retailers in their communication with consumers.

As the EmpCo Directive applies to consumer-facing products, feed mills are not required to take immediate action.

However, the updated ASC label will become the global standard and feed mills will transition to the new label by 31 December 2027.

Seaweed operations that meet the standard gain the right to sell their products bearing the ASC-MSC label. This gives them a public endorsement of their responsible practices, and gives consumers the reassurance that they’re making an ethical purchase. Only organisations that have signed a formal written licensing agreement with our licensing team may display the label on their products.

Standard fees

Once you’ve signed a licence, you are liable to pay annual fees and, depending on the label application, royalties.

Food service fees

Foodservice businesses with 225 sites or less will pay an annual fee to use the ASC label on their menu and other marketing materials, plus additional royalty site fees for operators with more than one site.

Feed fees

Once you’ve signed a feed license agreement, you are liable to pay fees on an annual basis (January-December).
